Fundamental Rights

Fundamental Rights are those rights which are considered necessary for the development of the personality of an Individual. They are included in the constitution so that every citizen can enjoy them and no one is able to encroach upon them.

Fundamental Rights as given in our constitution.
1. Right to equality
2. Right to freedom
3. Cultural & Educational Rights
4. Right to Religious Freedom
5. Right Against Exploitation.
6. Right to Constitutional Remedies

"The right to freedom is actually a cluster of General Rights" like...

a) Right to freedom of speech & expression
b) Right to assemble peacefully & without arms.
c) Right to form associations & unions
d) Right to freedom of movement throughout India.
e) Right to practice any profession or to carry out any occupation, trade or business.

When an emergency is declared, these rights can be suspended by the central govt.

Directive Principles of the state policy are instructions or directions given by the constitution to govt. to keep in mind while making laws or adopting policies.

They help in establishing social and economic equality

They help in establishing a just society. Difference between both are that fundamental rights are GUARANTEED by the constitution and are JUSTIFIABLE i.e. we can move to courts if our rights are INFRINGED.

DIRECTIVE PRINCIPLES OF STATE POLICY are mere Guidelines or directions, they are non-justifiable i.e. we cannot approach courts if they are not applied by the Govt.
